1. Acceptance of Terms
Welcome to VibeGigs ("we," "us," "our," or "the Service"). By accessing or using vibegigs.com and related services, you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms apply to all users, including visitors, registered users, and content contributors.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 13 years of age to use VibeGigs. If you are under 18, you represent that you have obtained parental or guardian consent to use this Service.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Maintain and update your information to keep it accurate
- Immediately notify us of any unauthorized use of your account
- Not share your account with others
3. User Content and Conduct
3.1 Content Ownership
You retain all rights to the content you post on VibeGigs ("User Content"). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content in connection with operating and promoting the Service.
3.2 Prohibited Content
You agree not to post content that:
- Violates any applicable law or regulation
- Infringes on intellectual property rights of others
- Contains malware, viruses, or harmful code
- Is defamatory, obscene, pornographic, or offensive
- Promotes violence, discrimination, or harassment
- Impersonates any person or entity
- Contains private information of others without consent
- Constitutes spam or unsolicited advertising

5. Paid Services and Subscriptions
5.1 Pro Subscriptions
VibeGigs offers paid subscription plans ("Pro") that provide additional features. By subscribing, you agree to pay the fees associated with your chosen plan.
5.2 Billing and Payment
- Subscriptions are billed in advance on a monthly or yearly basis
- Payments are processed through Stripe
- All fees are non-refundable unless required by law
- We reserve the right to change pricing with 30 days' notice
5.3 Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that date.
6. Job Postings
For job postings on the platform, you represent and warrant that:
- You have the authority to post the job listing
- The job listing is accurate and not misleading
- The position complies with all applicable employment laws
- You will not discriminate based on protected characteristics
7. Privacy and Data Protection
Your use of VibeGigs is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Disclaimers and Limitation of Liability
8.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 No Guarantee of Results
We do not guarantee that use of the Service will result in employment, job placements, or any specific outcomes. We are not responsible for the accuracy or reliability of User Content, including job listings.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use of or inability to use the Service
- Unauthorized access to or alteration of your content
- Conduct or content of third parties on the Service
- Any content obtained from the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless VibeGigs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another party
10. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and content
- Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will remain in effect
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
11.2 Jurisdiction and Venue
Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
11.3 Arbitration
For disputes not resolved informally, you agree to resolve disputes through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek equitable relief in court for intellectual property infringement or other urgent matters.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VibeGigs regarding the Service.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
